General terms for the use of the internet service of HOME BROKER SA. by users


I. GENERAL PROVISIONS

These “General terms regarding the use of the Internet thematic service of Home Broker SA" determine rules referring to users’ free of charge use of the service named "Home Broker", on which Home Broker inserts information on real property and finances


II. DEFINITIONS

The following terms used in the "General terms regarding the use of the Internet thematic service of Home Broker" shall have the following meaning:

  • Home Broker - the company of Home Broker S.A. with the headquarters in Warsaw, at ul. Przyokopowa 33, entered into the National Court Register under the number: 386307 whose registration files are maintained by the District Court for the capital city of Warsaw, XIII Economic Division of the National Court Register, with the share capital in the amount of PLN 9,800,000 paid in whole, REGON number: 141012293, NIP [tax identification number]: 527-254-59-11, being the creator and owner of rights in the thematic service, entitled to dispose of its resources.
  • Service - the thematic service of Home Broker, devoted to issues regarding real property and finances.
  • Service resources - resources rendered available within the scope of the service, on terms and within the scope determined in these "General terms regarding the use of the Internet thematic service of Home Broker SA", materials covering, in particular, information, job advertisements, articles and contact forms for Users of the service. The service resources consist of the information service.
  • Information service - service resources that are available to each User without any need to register.
  • User - person making use of the service resources within the scope provided for in these Regulations.

III. DETERMINATION OF RULES FOR USERS TO ACCESS THE SERVICE RESOURCES

1. The access to the part of service resources defined as the information service is not conditioned on the User’s meeting of any formalities; in particular, such access does not require the User to register in the system.

2. Home Broker recommends to use the following browsers while using the Service:
- MS Internet Explorer from 8.0,
- Firefox from 3.0,
- Chrome from 10.0,
- Opera from 10.0.
Users’ IT systems shall have cookies and Javascript enabled.


IV. COMMITMENTS OF HOME BROKER

Home Broker offers Users a free of charge access to the resources of the information service for an unlimited period of time.


V. COMMITMENTS OF THE USER

1. The User shall be obliged to use the Service in compliance with the law, provisions of these "General terms regarding the use of the Internet thematic service of Home Broker SA" as well as good practices.

2. The User is entitled to use the service resources exclusively for his/her personal purpose. The above mentioned shall mean in particular, with reference to data as well as all other materials included in the service resources, both those which are subjected to protection with regard to the copyright as well as those that are not subjected to such protection, that the User is not allowed to use the above mentioned materials to run any competitive activity.


VI. RESPONSIBILITIES of THE PARTIES

1. Home Broker declares that materials and information constituting the service resources are collected and edited with due care. The information presented does not constitute any offer in the light of Art. 66 and 71 of the Civil Code (Journal of Laws of 1964 No. 16, item 93). Presented plans of the real property are indicative and referential only. Certain announcements, present, instead or next to the photographs of the real property, also exemplary visualizations of interior arrangements. Home Broker does not bear any liability for any decisions of the User undertaken on the basis of information obtained as a result of using the service resources.

2. User shall bear full liability towards any third parties with regard both to the content of the information provided by the User as well as texts inserted by the User in the Service.

3. Moreover, Home Broker shall not bear any liability in case when service resources are not available due to any breakdown of the telecommunication system or other consequences of a defective operation of telecommunications connections or damage caused by them.


VII. PROCESSING OF PERSONAL DATA OF THE SERVICE USERS

1. The User’s data will be processed by Home Broker S.A. on the basis of a separate consent of the person to whom data refer, expressed by ticking of an appropriate box of the form. The User’s data will be processed:

- within the scope necessary for offering products and services, also of entities cooperating with Home Broker S.A. in relation to property brokerage executed by Home Broker S.A.;

- for the purpose of sending commercial information, in compliance with Art. 10 item 2 of the Act of 18 July 2002 on provision of services by electronic means (Journal of Laws of 2013 item 1422 as amended).

- for the purpose of rendering available within the scope covering name, surname, telephone number, e-mail address, information regarding the preferred product / service of Open Finance S.A. with the headquarters in Warsaw (01-208), at ul. Przyokopowa 33, for marketing purposes, including offering products and services of entities cooperating with Open Finance S.A., in particular, within the scope of brokerage of Open Finance S,A. consisting in presenting forms of financial investment, assistance in the selection of financial, insurance and investment products.

- for the purpose of rendering available within the scope covering name, surname, telephone number, e-mail address, postal code, information regarding the preferred product / service of Open Brokers S.A. with the headquarters in Warsaw (01-208), at ul. Przyokopowa 33, for marketing purposes, including offering products and services of entities cooperating with Open Brokers S.A., in particular, within the scope of insurance brokerage carried out by Open Brokers S.A.;

- for the purpose of rendering available within the scope covering name, surname, telephone number, e-mail address, information regarding the preferred product / service of HB Finanse Sp. z o.o. with the headquarters in Warsaw (01-208), at ul. Przyokopowa 33, for marketing purposes, including offering products and services of entities cooperating with HB Finanse sp. z o.o., in particular, within the scope of brokerage of HB Finanse sp. z o.o. consisting in presenting forms of financial investment, assistance in the selection of financial, insurance and investment products.

2. Home Broker S.A. with the headquarters in Warsaw (01-208), at ul. Przyokopowa 33, is the controller of personal data provided by you. Your personal data will be processed for marketing purposes, against your voluntary consent for being offered products and services, among others, of entities cooperating with the controller in relation to the execution by Home Broker S.A. property brokerage as well as for sending commercial information. Pursuant to your separately granted consents, your personal data may be rendered available to Open Finance S.A. and Open Brokers S.A., as well as other entities cooperating with the controller. At the same time, your personal data will be processed for archiving purposes. The provision of your personal data is on voluntary basis. You shall have the right to control, access the contents of your data and to correct them.

3. Pursuant to Art. 7 point 5 of the Act of 29 August 1997 on personal data protection (that is, Journal of Laws of 2015, item 2135 – hereinafter the Act), the User shall have at any time the right to withdraw his/her consent for the Controller to process his/her personal data. The User may make use of this right by sending an appropriate demand together with his / her name and surname to the e-mail address: kontakt@homebroker.pl.

4. The User, by ticking an appropriate box in the registration form, may refuse or give his / her consent for obtaining commercial information by electronic means of communication, in compliance with the Act of 18 July 2002 on provision of services by electronic means (Journal of Laws of 2013, item 1422 as amended). In case when the User has agreed to receive commercial information by electronic means of communication, he / she shall have the right to revoke this consent at any time. The User may exercise his /her right to revoke such consent for obtaining commercial communications by sending an appropriate demand together with his / her name and surname to the Data Controller (kontakt@homebroker.pl).

5. Home Broker S.A. executing its obligation, referred to in Art. 25 item 1 of the Act, kindly informs that Home Broker S.A. with the headquarters in Warsaw (01-208), at ul. Przyokopowa 33, is the controller of your personal data covering name, surname, telephone number, e-mail address, and information regarding a preferred product /service. Based on your consent, your personal data have been obtained from Open Finance S.A. with the headquarters in Warsaw (01-208), at ul. Przyokopowa 33, for marketing purposes, including offering products and service of, among others, entities cooperating with Home Broker S.A. in relation to property brokerage carried out by Home Broker S.A. Based on your separate consent, the above mentioned personal data may be shared with other entities cooperating with the controller. At the same time, your personal data will be processed for archiving purposes. You shall have the right to access and correct your data, as well as the right to make a written, justified request to cease processing your personal data due to your special situation and the right to object to the processing of your data for marketing purposes or to transfer them to another data controller, in accordance with Article 32 item 1 of points 7 and 8 of the Act.

6. All telephone conversations with consultants, taking care of the quality of services, are recorded.


VIII. FINAL PROVISIONS OF THE AGREEMENT

1. These Regulations serve as general terms and conditions of in the light of the provisions of the Civil Code.

2. In case of any amendment to these Regulations, such amendment will be rendered available to Users by its presentation on the websites of the Service.

3. No Party may transfer its rights stemming from this Agreement to any third party without a written consent of the other Party.

4. Any and all remarks, comments and questions regarding the operation of the Service shall be addressed to the headquarters of Home Broker as well as to the e-mail address: kontakt@homebroker.pl.

5. Any complaints concerning the Service shall be submitted by e-mail to the e-mail address: kontakt@homebroker.pl.

6. Information on the outcome of the complaint procedure shall be provided to parties interested by traditional letter or e-mail within 14 days of Home Broker's clarification of the complaint event. The complaint procedure should not last longer than 2 months, counting from the date of the complaint submission.

7. The Parties to the Agreement undertake to settle out of court any disputes arising in relation to the execution of this Agreement.
